Terms of Service

By accessing or using Gamers After Dark ("GAD," "the Platform," "we," "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

Your continued use of the platform after we post changes to these terms constitutes acceptance of those changes. We will notify users of material changes via email or prominent notice on the platform.

This platform contains sexually explicit content intended for adults only. Allowing a minor to access this platform is a violation of these terms and may be illegal. If you know of a minor accessing this platform, contact us at compliance@gamersafterdark.com immediately.

Independent contractor status. Creators are independent contractors, not employees, agents, or partners of GAD. You are responsible for your own taxes, legal compliance, and business obligations.

Revenue share. GAD retains 20% of gross creator earnings as a platform fee. Creators receive 80%. This split applies to all revenue streams including subscriptions, gifts, tips, PPV messages, clip sales, lobby requests, and VIP sessions. There are no hidden fees beyond this split.

Content standards. Creators agree to:

• Only post content featuring performers who are 18 years of age or older
• Maintain 2257 records for all performers and produce them upon lawful request
• Not misrepresent themselves or their content
• Respond to DMCA takedown notices promptly
• Comply with all applicable laws and regulations
• Not stream or post content that violates these terms

Payout schedule. Earnings are processed and paid according to the payout schedule communicated during onboarding. GAD reserves the right to withhold payment pending fraud investigation or compliance review.

Account termination by creator. Creators may close their account at any time. Earned and cleared funds will be paid out at the next scheduled payout date.

Subscriptions. Fan subscriptions are billed monthly on the date of initial purchase. You may cancel at any time; cancellation takes effect at the end of the current billing period. You will retain access until the period ends.

Refund policy. All purchases "” including subscriptions, gifts, tips, and PPV messages "” are final and non-refundable, except where required by applicable law. If you believe you have been charged in error, contact support@gamersafterdark.com within 7 days.

Age verification. By subscribing or making any purchase, you confirm you are 18 or older. We reserve the right to require additional age verification at any time.

Acceptable use. Fans agree to:

• Not share, download, redistribute, or republish any creator content without written permission
• Not record, screenshot, or capture live streams for distribution
• Not harass, threaten, or abuse creators or other users
• Not attempt to manipulate pricing, gain unauthorized access, or reverse-engineer the platform
• Maintain only one account per person

Content is for personal viewing only. Your subscription grants you a personal, non-transferable license to view content during the subscription period. It does not grant you ownership of any content.

The following content is strictly prohibited and will result in immediate account termination, content removal, and potential reporting to law enforcement:

• Any depiction of minors in any sexual or suggestive context "” zero tolerance, zero exceptions
• Content depicting or facilitating human trafficking
• Non-consensual content of any kind
• Content depicting or facilitating illegal activity including drug use, weapons offenses, or financial crimes
• BDSM, restraint, or power-exchange content without explicit prior platform approval and documented performer consent
• Humiliation, degradation, or content designed to demean performers in a non-consensual context
• Incest, rape fantasy framing, or content sexualizing family relationships
• Content involving real people who have not consented to appearing on this platform
• Doxing, threats, or content intended to harm specific individuals

Creators retain full ownership of their content. By posting content to GAD, creators grant GAD a limited, non-exclusive license to host, display, and distribute that content to subscribers in accordance with the creator's settings.

GAD retains all rights to its platform, brand, software, and infrastructure. The GAD name, logo, and branding may not be used without written permission.

All financial transactions are processed by our payment processor. By making a purchase, you agree to the payment processor's terms of service in addition to these terms.

Chargebacks and payment disputes are taken seriously. Fraudulent chargebacks will result in account suspension and may result in recovery of funds plus any applicable fees.

All prices are in USD. Applicable taxes are the responsibility of the purchasing party.

GAD reserves the right to suspend or terminate any account at any time for violation of these terms, suspected fraud, illegal activity, or at our sole discretion.

Creators whose accounts are terminated for prohibited content violations will forfeit any outstanding earnings held in escrow during the review period. Creators terminated for reasons other than prohibited content will receive their earned and cleared balance at the next payout date.

Fan accounts terminated for chargebacks, abuse, or policy violations may not re-register without written approval.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAMERS AFTER DARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

GAD's total liability to you for all claims arising from or related to these terms or your use of the platform shall not exceed the greater of (a) the total amount you paid to GAD in the 12 months preceding the claim, or (b) one hundred dollars ($100).

GAD is a platform. We do not produce, direct, or participate in creator content. Creators are solely responsible for their content and their compliance with applicable laws.

ANY DISPUTE ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, NOT IN COURT, except that you may assert claims in small claims court if your claims qualify.

Arbitration shall be conducted by a recognized arbitration provider under its applicable rules. The arbitration shall take place in Pennsylvania. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You and GAD both waive any right to a jury trial. You agree that any dispute will be resolved individually and not as part of a class or collective action.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST GAMERS AFTER DARK. All claims must be brought individually. If this class action waiver is found to be unenforceable, the entire arbitration provision shall be void and claims must be brought in court in Pennsylvania.

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Pennsylvania.

We may update these terms at any time. We will post the updated terms on this page with a revised "Last updated" date. For material changes, we will notify registered users via email at least 14 days before the changes take effect.

Your continued use of the platform after changes take effect constitutes your acceptance of the new terms. If you do not agree to the new terms, you must stop using the platform and may close your account.
