Terms of Service

By accessing or using Gamers After Dark ("GAD," "the Platform," "we," "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

Your continued use of the platform after we post changes to these terms constitutes acceptance of those changes. We will notify users of material changes via email or prominent notice on the platform.

Gamers After Dark welcomes creators and fans of every sexual orientation and gender identity. Discrimination or harassment against anyone on that basis is a violation of these terms.

This platform contains sexually explicit content intended for adults only. Allowing a minor to access this platform is a violation of these terms and may be illegal. If you know of a minor accessing this platform, contact us at compliance@gamersafterdark.com immediately.

Independent contractor status. Creators are independent contractors, not employees, agents, or partners of GAD. You are responsible for your own taxes, legal compliance, and business obligations.

Revenue share. Creators retain 70% of gross eligible creator earnings, excluding separately collected taxes. GAD retains 30% and pays processing costs from its share. Gifts, Play, and private 1:1 sessions are attributed to the receiving creator. Participation is always nonexclusive. Each subscriber funds a creator share allocated among creators they actually watch, using verified foreground playback and one accounting stream at a time. Non-use does not trigger a refund or stop renewal. Verified zero-view membership creator shares are divided equally across participating creators. Period-specific eligibility still needs defining. Missing viewing evidence goes to review. Creator pools round up to a cent; remaining cents are distributed proportionally with stable creator-ID tie breaks. Settlements are not open. These remain draft terms pending provider and legal review.

Content standards. Creators agree to:

• Only post content featuring performers who are 18 years of age or older
• Maintain 2257 records for all performers and produce them upon lawful request
• Not misrepresent themselves or their content
• Respond to DMCA takedown notices promptly
• Comply with all applicable laws and regulations
• Not stream or post content that violates these terms

Payout schedule. The allocation policy is selected. Verified reconciliation, payout delivery, and provider review remain required. No new settlement or payout schedule is promised by this draft.

Account termination by creator. Creators may close their account. Participation is always nonexclusive. Payout and reversal treatment must be finalized before billing opens.

Memberships. Main Floor is $19.99/month for participating public streams. VIP membership is $29.99 total per month and adds room chat and eligibility for separately paid Play and coming-soon AI DMs. Both renew until canceled. Non-use does not trigger a refund. Creator availability is not guaranteed. No paid experiences or gifts are included. Billing is closed.

Private 1:1 payment and refunds. Private 1:1 requests are free. The creator approves the offer; you confirm the exact price and duration and pay. No charge or hold occurs before confirmation. Paid time starts only when both people are connected and the creator presses Start private session. Cancel before start for a full refund. Creator cancellation also earns a full refund. An immediate session not started within five minutes after payment, or a scheduled session not started within five minutes after its agreed start, receives a full refund. Disconnections pause paid time for up to two minutes per incident; an unsuccessful reconnection ends the session and unused time is refunded. Voluntarily leaving after start solely for a change of mind earns no refund. The daily Play limit does not apply to private 1:1 sessions. Private 1:1 requests require an active Main Floor or VIP membership. VIP members receive the lower creator-controlled price. Approved suggestions are $60 for ten minutes for VIP members and $75 for Main Floor members. Payments remain disabled.

Play eligibility. VIP membership is required to request separately paid Play. Requests are free; creator approval and exact-price confirmation are required before payment. Suggested Play price is $15 per game or round, editable by the creator. No membership guarantees admission, attention, or priority.

Refund policy. Play counts as started only once the fan is connected and the creator presses Start game. Immediate Play that has not started within five minutes after successful payment receives a full refund. Paid scheduled rounds that have not started within five minutes after their scheduled start time also receive a full refund. Changing the time of a paid round requires your explicit agreement. You can receive a full refund when you decline the change. During timed Play, a disconnection pauses the paid clock and allows two minutes to reconnect. After two minutes without reconnection, the session ends and unused paid time is refunded. Round-based Play allows two minutes to reconnect. An interruption that prevents the fan from completing the purchased round receives a full refund. Creator cancellation still means a full refund. Voluntarily leaving after Play starts because of a change of mind does not qualify for a refund. Approved technical-failure and creator-cancellation refunds still apply. After a fan reaches two counted Play disconnections in one day, further Play attempts across GAD are blocked until the next day. Only confirmed fan-side disconnections during an active Play session count. Creator-side failures, GAD outages, and disconnections outside Play do not count. Unclear causes require review. The daily limit resets at midnight Eastern Time, following daylight saving time. The exact unlock time will be displayed to the fan. Already-paid Play that cannot start because of the daily Play restriction receives a full refund. This limit is not active yet. Fans who cancel a paid Play purchase before the game starts receive a full refund. Creator cancellations and games that never start also receive full refunds. These outcomes are approved. Money and access describes the selected expiry, refund, and membership rules. Payments remain disabled pending integration and provider review. The prior blanket final-sale language does not apply to this proposed model.

Age verification. By subscribing or making any purchase, you confirm you are 18 or older. We reserve the right to require additional age verification at any time.

Acceptable use. Fans agree to:

• Not share, download, redistribute, or republish any creator content without written permission
• Not record, screenshot, or capture live streams for distribution
• Not harass, threaten, or abuse creators or other users
• Not attempt to manipulate pricing, gain unauthorized access, or reverse-engineer the platform
• Maintain only one account per person

Content is for personal viewing only. Main Floor membership provides personal, non-transferable access to participating public streams during the paid period. It does not grant you ownership of any content.

The following content is strictly prohibited and will result in immediate account termination, content removal, and potential reporting to law enforcement:

• Any depiction of minors in any sexual or suggestive context — zero tolerance, zero exceptions
• Content depicting or facilitating human trafficking
• Non-consensual content of any kind
• Content depicting or facilitating illegal activity including drug use, weapons offenses, or financial crimes
• BDSM, restraint, or power-exchange content without explicit prior platform approval and documented performer consent
• Humiliation, degradation, or content designed to demean performers in a non-consensual context
• Incest, rape fantasy framing, or content sexualizing family relationships
• Content involving real people who have not consented to appearing on this platform
• Doxing, threats, or content intended to harm specific individuals

Creators retain full ownership of their content. By posting content to GAD, creators grant GAD a limited, non-exclusive license to host, display, and distribute that content to subscribers in accordance with the creator's settings.

GAD retains all rights to its platform, brand, software, and infrastructure. The GAD name, logo, and branding may not be used without written permission.

All financial transactions are processed by our payment processor. By making a purchase, you agree to the payment processor's terms of service in addition to these terms.

Chargebacks and payment disputes are taken seriously. Fraudulent chargebacks will result in account suspension and may result in recovery of funds plus any applicable fees.

All prices are in USD. Applicable taxes are the responsibility of the purchasing party.

GAD reserves the right to suspend or terminate any account at any time for violation of these terms, suspected fraud, illegal activity, or at our sole discretion.

Creators whose accounts are terminated for prohibited content violations will forfeit any outstanding earnings held in escrow during the review period. Creators terminated for reasons other than prohibited content will receive their earned and cleared balance at the next payout date.

Fan accounts terminated for chargebacks, abuse, or policy violations may not re-register without written approval.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAMERS AFTER DARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

GAD's total liability to you for all claims arising from or related to these terms or your use of the platform shall not exceed the greater of (a) the total amount you paid to GAD in the 12 months preceding the claim, or (b) one hundred dollars ($100).

GAD is a platform. We do not produce, direct, or participate in creator content. Creators are solely responsible for their content and their compliance with applicable laws.

ANY DISPUTE ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, NOT IN COURT, except that you may assert claims in small claims court if your claims qualify.

Arbitration shall be conducted by a recognized arbitration provider under its applicable rules. The arbitration shall take place in Pennsylvania. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You and GAD both waive any right to a jury trial. You agree that any dispute will be resolved individually and not as part of a class or collective action.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST GAMERS AFTER DARK. All claims must be brought individually. If this class action waiver is found to be unenforceable, the entire arbitration provision shall be void and claims must be brought in court in Pennsylvania.

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Pennsylvania.

We may update these terms at any time. We will post the updated terms on this page with a revised "Last updated" date. For material changes, we will notify registered users via email at least 14 days before the changes take effect.

Your continued use of the platform after changes take effect constitutes your acceptance of the new terms. If you do not agree to the new terms, you must stop using the platform and may close your account.
